1. GENERAL REGULATIONS

Document about House rules in Vila Zvezda danica Maribor (Vila Zd Mb) is taking care of the rights and duties of residents of the House and rights and duties of the owner of the House and company Zvezda danica d.o.o., that is represented by Janko Obrulk, director on the other side.
House order is defining minimal standards of co-living.
Acceptance of the House order those not mean that the owner or management is institutional guardian of residents (like in other student dormitories). Code of Conduct – House Rules is a necessary document because of the young age of residents and is a clear agreement what is allowed and welcomed in the House and what is not.

Owner of Vila Zvezda danica Maribor (in following text: owner) determines management and caretaker for enforcement of rights and duties in Vila Zvezda danica Maribor.

Representors of residents in Vila Zvezda danica Maribor are selected by the floor and elected with majority of votes of certain floor.
Range of authorization for representors is defined and decided by management of Vila Zvezda danica Maribor.
3. House workers
Service and activity of House workers in Vila Zvezda danica Maribor is defined by the owner itself.

V. RULES ABOUT MOVING IN VILA ZVEZDA DANICA MARIBOR

a) Student can move in Vila Zvezda danica only based on signed accommodation contract.
During the process of Moving in the house Student must submit:
- Valid accommodation contract
- Copy of personal document/ID or passport
- Student ID, that Students receive when signing in at the Faculty
- Filled documents for Residence permit
- Deposit, that is changed to security payment when signing the contract and it belongs to management of the House till the departure.

c) For a Student that has to evict because of disciplinary actions and has a forced stop of accommodation Contract in Vila Zvezda danica Maribor there is no more possibility to move in Vila Zvezda danica Maribor and is baned from former night stay and hanging out in the house without the permission of the owner of Vila Zvezda danica Maribor.

When all administration papers are in order students receives a promissory note, key of the room, apartment room, dumpster and bicycle shed, also bed sheets (if wanted). Promissory note is signed in two issues, one is received by the student and one belongs to the management of the house.

Same rule applies to other mixed couples (relatives, classmates, friends). Living with children is not possible in Vila Zvezda danica Maribor.

After dissolution or suspension out of law commitment or other form of mixed couples Student dormitories will try to find other accommodation possibilities if possible.

Vila Zvezda danica Maribor is also not creating an environment needed for children growth. Based on that mother with child losses the right to live in Vila Zvezda danica Maribor.
IV ACCOMMODATION RULES IN VILA ZVEZDA DANICA MARIBOR

Resident is fully responsible for his private property. In case of larceny (theft) management of Vila Zvezda danica Maribor or company Zvezda danica d.o.o. are not responsible for the damage and resident is not entitled to any kind of cost payment.
21. article
Residents of Vila Zvezda danica Maribor are fully responsible for their actions and they fully take care of all consequences for their own actions. In case of strong fights between residents or visitors that can bring to physical and mental damages, Vila Zvezda danica Maribor and her owner Zvezda danica d.o.o. are not taking care of the responsibility and damage that was done to injured party. Injured party has to gain the payment of costs by himself, via civic lawsuit directly from the person who cussed him the damage. In case of those actions residents of Vila Zvezda danica Maribor are obliged to contact the management of Vila Zvezda danica Maribor instantly.

Vila Zvezda danica Maribor and owner Zvezda danica d.o.o. are not responsible for possible study failure of the residents.

Residents are using the equipment and devices and the whole building by their own responsibility. In case of imperfections is their duty to instantly inform the caretaker of the House.
VII. RIGHTS OF RESIDENT FOR USING THE ROOMS, COMMON SPACE AND DEVICES IN VILA ZVEZDA DANICA MARIBOR
24. article
At regular rent payment and other costs resident of Vila Zvezda danica Maribor has a right to:
- using their bed in room;
- healthy and safe home;
- using room inventar;
- using warm and cold water;
- using internet in the room;
- using electrical energy for electrical devices that belong to house;
- heating in the house during cold months;
- using common kitchen space;
- using bathroom and toilets;
- using wireless internet in the House;
- cleaning and maintenance of common space in the house (toilets, kitchen (does not include washing the dishes), hallways, common space, stairways) 3 times per week;
- maintenance of installation and devices in the house;
- using common space;
- using extra heating devices and lighting under the next conditions:
a) Heating devices
All extra heating devices, that student is using in the room must be reported to caretaker of the house; there must be information if they are tested with valid tests.
Safe usage of heating device:
- heating device can be used only when student is physically in the room;
- heating device must be placed in a way, that there is no chance of fire;
- if student is not in the room heating device must be unplugged from electricity system;
- all heating devices must work with no problem, otherwise the device must be removed or put in the storage room of the House.
Usage of extra heating device and other extra usage of electric energy is going to be charged at rent payment, by valid price list of Vila Zvezda danica Maribor.
Usage of non-reported heating devices is a high violation of House order. In case that unreported heating device is found, student is reminded first to report the device or to remove it. In case this gets repeated and unreported heating device is found second time or if the device is not used safely student must move out of the apartment, because of fire safety.
b) Lighting
– lighting in the house is installed by regulations of producer;
– resident is not allowed to change the power of light bulbs by his own will;
– all extra lighting devices that are brought and used by the students must be in perfect condition and need to have valid attest, with power of lightbulb that is regulated by the producer.
c) Other electrical device
– all electrical devices and machines that are brought and used by student must be in perfect condition with valid attest and must not threaten fire safety (refrigerators, television etc.) For usage of refrigerators and television is defined extra monthly payment.
VIII. DUTIES OF RESIDENTS TO VILA ZVEZDA DANICA MARIBOR
1. Rent
25. article
Resident of the house has a duty to pay all costs for accommodation in Vila Zvezda danica Maribor.
26. article
Price of rent that covers the costs and is defined from rights in house order is defined and regulated by the owner itself.
27. article
Rent must be payed immediately when resident moves in, and for the following months till 8. day in the month.

If costs for the rent are not payed till 18. day in the month, resident receives a warning. There are extra cots for warning note. For all delayed payments are extra interest payment.

If resident does not pay the debt till 25. day in the month, there is a second warning and this is a warning before moving out and cancelation of accommodation contract. Second warning is priced by the price list of Vila Zvezda danica Maribor. If costs and debt is not payed till 28. in the month resident must move out in the last of day of the month.

All debt, possible extra damage costs and costs of committee must be payed by guarantor, if there is no other possibility, there is a mandate lawsuit by the owner of the house.

Owner has a right to payment of all interests in case of late payment, by the law of interest payment.
2. Payment of other costs and extra damage

For extra attentional or sloppiness done damage, the resident is personally responsible and is his duty to pay it till the date decided by the owner. There is more detailed information about this in articles about material responsibility.
3. Usage of room, inventory, common space and devices

Residents duty is to use the rooms, inventory, devices, installation and common space in regulation with their attention and as good landowners. Is their responsibility and duty to use them in correct way and to protect them from damage and ill-treatment.

Residents duty is to clean their own rooms, all residents must be solidary and all must clean the bathroom space.

Residents must behave in the house in the way, that they do not interfere with personal freedom and rights of other residents and that they are not disturbed in study and rest time.
Celebrations are allowed in case, that resident notifies caretaker of the house or security via special form, one day before the event.
Kitchen place is meant only for eating. In kitchen is strictly forbidden to smoke!
- Drinking and rioting is strictly forbidden.
- After 10pm/22:00 all parties and loud behavior must end, it is time of night peace.

In case of infectious disease or other serious disease resident must report this to management of Vila Zvezda danica Maribor. It’s resident duty to treat the disease, especially if it is contagious.

For cleanliness in living space, that is resident duty to clean by himself controls health commission. Health commission is selected a new for each inspection by the owner.

Residents of the house must be noted about the health inspection with message on the house board (date, hour).

Resident that is not maintaining the cleanliness in spaces, that he/she must clean by himself commission notifies with appropriate date, to take care of the irregularity. If resident is not in the room on the date of inspection he/she receives a note. If after another checkup/inspection irregularity is not fixed, health commission initiates the procedure for disciplinary commission.
4. Visitors duty and visitor notice

Resident of Vila Zvezda danica Maribor can receive a visit in his/her room, if the roommate agrees with it.

For all possible damage, noise and other violations is resident responsibility that accepted the visitor. Outside visitors of party, social event in Vila Zvezda danica Maribor must leave the house till 22:00 (10 pm). Resident that invited the visitors is responsible for all disciplinary and material responsibility. In case of violations this belongs under heavy violation of the house order.

a) In case, that a visitor, that is not a resident of the house wishes to stay after 22:00 (10 pm) or sleep over, must resident of the house that invited the visitor hand over the APPLICATION FOR SLEEP OVER, till 20:00 (8 pm) of that day.
b) Visitor or partner ma sleep over for free only 2 times in the month. If visitor wishes to stay over more often, resident of the house must pay costs for night accommodation. Resident receives a receipt/bill on the end of the month. Price of night accommodation is determined with a price list.

Visitor, that is staying in the house without notice between 22. and 6. hour (10 pm and 6 am), must legitimize himself instantly and leave the house. In contrary owner calls the police. Resident that accepted the unregistered visitor receives a penalty of double price for night accommodation of the visitor and written notice.
Resident of the house has a right for normal work and peace in the student room, because of these reason coresident/roommate is not allowed to disturb him/her with visitors. In case of disagreement between roomates, must the one that is making most of the trouble move out.
VIII. DISCIPLINARY RESPONSIBILITY AND DISCIPLINARY MEASUERS
1. General regulations

About resident house order violation and disciplinary responsibility is decided by management and house caretaker with agreement of the owner.

a) Lighter violations of house violations are established by the caretaker of Vila Zvezda danica Maribor with agreement of the owner. In case of established violation house caretaker may give one of the following measure:
– written warning
– money ticket
– reminder before eviction
– eviction with prohibition of moving in again
b) Violations of house order and responsibility for those are established by the house caretaker of the owner iftself. House caretaker or owner is allowed to impose one the measures.

If resident with his behavior heavily violates the house order or threatens other resident life or health and when/if he threatens material resources, caretaker or owner of the house is allowed to evict the resident for temporary or permit time from Vila Zvezda danica Maribor.

Against eviction measurement there is no possibly complaint.
2. Violation of resident duties

Violation of resident duties it’s each act or treatment, that is not in order with house rules, decisions of committees or other legal organs of Vila Zvezda danica Maribor. And violation of general law provisions (law about residence permit, public peace and order, fire safety of Republic of Slovenia…).

a) Easier violations of house order are:
– unregular cleaning of the room and commons living space,
– inappropriate behavior towards co-resident or house worker,
– incorrect treatment of inside installation, devices and house objects,
– inconsideration of instructions, notices and decisions of committees and owner of Vila Zvezda danica Maribor,
– not going to the doctor in case of infectious disease,
– uneconomical use of electric energy and water,
– violation of peace with too loud usage of music devices, TV, personal computers, yelling and singing in all places of the house and space that belongs to Vila Zvezda danica Maribor.
b) Harsh violations of house order are:
– renting or giving a chance to use the accommodation to non-residents of the house,
– sleeping over and staying in the house of the former resident in Vila Zvezda danica Maribor,
– night accommodation (sleep over) of non-applied visitor,
– damaging the house property or changes of house property,
– arbitrary action of moving out or moving in,
– not enabling to move in for a new resident,
– any kind of act, that is defined as criminal act and has been acted on by the official state organ,
– nonpayment of debt after 2. notice, and after 30. day in the month,
– violation of night peace after 22. hours (10 pm),
– organization of parties, that are disturbing the residents of the house,
– occupation that is not registered (shop, value exchange…),
– fighting,
– harassment of co-resident or other inappropriate behavior with which are not enabled normal living conditions to another resident of the house,
– not enabling entry to the room to workers in the house, by chancing the locks, and in case if resident does not open the door when demanded,
– giving false information, documents,
– growth and consuming prohibited drugs,
– extensive alcohol drinking,
– plugging in electric devices with over 100W, without noticing the house management,
– not following the measurement of the owner,
– throwing different objects (bottles, furniture, other heavy objects, bags with water, spilling water on passing by people and other house places,
– repeating same violations of the house order,
– any kind of violation after eviction notice,
– actions that follow with pollution the house or damaging house property,
– organizing hazard game events for money in the house place or being part of such event,
– smoking in the house, because that is prohibited.
IX. PROCEDURE OF ESTABLISHING VIOLATIONS OF HOUSE ORDER
1. Initiation of disciplinary procedure

Initiative for disciplinary procedure can be proposed in written or oral form by any resident of the house or worker of Vila Zvezda danica Maribor. Initiative can be anonymous; house caretaker must check it before the start of procedure. Initiative must contain basic information about the resident (first and last name, room) and description of violation and naming possible witnesses.

Disciplinary procedure may begin on demand of the owner or caretaker of the house.

Management of Vila Zvezda danica Maribor invites the violator to a discussion based on the report application.
2. Discussion
53. article
Owner invites the resident, violator for a discussion. Owner also invites the person/resident that gave the report application. If resident, that is under violation procedure does not want to respond to the invitation and clear out the reported violations, confirms his actions – by not responding to the invitation.

After the procedure (all the resident and witness statements) caretaker of owner decides about:
a) responsibility for the named violation (guilty of not guilty)
b) measurement suggestion

Owner must consider possible extenuating circumstances when deciding about responsibility and measurement suggestion.

In case of finding out that resident is responsible – guilty of house order violation, he/she receives a measurement action.

At violations owner and caretaker have a right to give written notice, notice before eviction and notice of canceling the contract. About all listed measurement owner and caretaker may notice also the parents.
3. Signing and evidence of violations

Decision about house order violation and measurement is signed in management evidence of Vila Zvezda danica Maribor and informs the Commission of Student dormitories in Maribor.
4. Deliverance of the order

Resident receives the official papers about measurement on his regular address. Foreign students receive the post on the address at Vila Zvezda danica Maribor.

If resident does not move out till deadline time, defined in house rules, there are valid procedures by the committee.
5. Following measurements about violation and further procedure

a) Acceptation committee for Vila Zvezda danica Maribor, considers residents attitude for house order as one of the criterion for acceptation or prolongation of living in Vila Zvezda danica Maribor.
b) Owner of Vila Zvezda danica Maribor holds the same right for accepting or prolongation of living in Vila Zvezda danica Maribor, based on residents or new residents, that showed inappropriate attitude for house order or any other order in other student dormitories in Slovenia.
IX. MATERIAL RESPONSIBILTY

Resident that makes a damage on purpose in Vila Zvezda danica Maribor, must pay for it. If damage is done by more than 1 resident, each must pay for their part of done damage.

If there is no possibility to find out who is the violator, damage costs must be payed by all residents in the place where the damage was done.

Done damage is determined by owner and house caretaker in Vila zvezda Danica Maribor.

In case when violator is known, he receives the bill for done damage at the end of the month, that he must pay at the same time as rent costs in the next month. If violator is not known, damage costs are payed by all the residents. Damage is evaluated based on the bill for a new product or service cost. Bill must contain the costs of removing the old equipment, installation of new product, travel expenses and price of new product.

If resident does not pay the material damage in deadline and in the way, that is determined, there is a compulsory settlement or even civil lawsuit.

Against the violator of material damage there also may be a disciplinary procedure.
X. RULES ABOUT RELOCATION

Resident of Vila Zvezda danica Maribor may change the rooms during his accommodation time in the house. Resident is allowed to change the room once in the study year, by the procedure defined in house rules.

Resident that wishes to move to another room, by any kind of reason in the same or other dormitory, must file in application till 25. day in current month, for relocation in the next month. Application must contain a reason for changing the room.

First relocation in study year is approved or denied by owner or house caretaker.

Resident that filed in application for relocation, must talk with the owner or house caretaker till 5. day in the following month. If relocation is approved resident receives a relocation paper.

Each following relocation is approved or denied by the caretaker of the house.

XI. RULES ABOUT MOVING OUT OF VILA ZVEZDA DANICA MARIBOR

Resident moves out of Vila Zvezda danica Maribor by his own wish or based on the resolution about losing the right to live in Vila Zvezda danica Maribor or in case, if his application for further accommodation was not approved.

In case that resident received a resolution about losing the right to live in Vila Zvezda danica Maribor, or he did not receive the right for further accommodation, resident moves out by the house rules.
If resident moves out till 15. day in the month he/she must pay half of the rent and other possible costs for current month, if he/she moves out later there is a payment of rent for the whole month.

Resident that intends to move out of Vila Zvezda danica Maribor by his own wish, must report this decision one month before the day of moving out, by sending the written letter to management of the house. This is done by canceling the accommodation contract till last day in the month. After filling in the cancelation of accommodation, there is a start of one month cancelation deadline.
Moving out deadline is based on the day that written later was send via the post office.

Moving out must be done in the last working day in the afternoon time.

At the moving out procedure resident must pay all finance responsibilities; house caretaker confirms the return of all house inventory that resident was using during his accommodation time in Vila Zvezda danica Maribor.

Room of the resident must be clean before renting it to the next person. All objects must be removed, that are not property of the house. Room and the furniture must be in the condition appropriate for the next resident. Room is check out by the house caretaker. Resident that is moving out must return the keys to the caretaker and from that moment on, there is no more right to enter the room.

If house caretaker or the owner judges that moving out resident must pay repairing costs of the room, cleaning of the room, there is an evaluation of costs and the resident receives a bill. With conformation of payed costs there is a final move out.

If resident does not have the money to pay for costs or damage cannot be evaluated right away, there is a promissory note. Caretaker or owner of the house than gives out appropriate bill with the damage costs. Resident must pay the bill in 8 days, otherwise he must pay the rent costs.

Resident is obligatory to move out of Vila Zvezda danica Maribor before the ending of accommodation contract:
- if that is decided by the caretaker or owner of the house,
- if resident receives eviction notice,
- if financial costs are not payed in time.

Resident that moves out of Vila Zvezda danica Maribor without acknowledgement in the house management, must pay the rent costs till the day he moves out by the procedure, defined in house rules, or till the day defined by house committee.

Resident that wishes to cancel the accommodation contract before the cancelation date, cannot move in Vila Zvezda danica Maribor for one year.
XII. RULES ABOUT COMMITTEE EVICTION IN VILA ZVEZDA DANICA MARIBOR

Resident that does not evict/move out by the procedure defined by house rules, must move out by the committee rules. Committee eviction begins right away after unsuccessful regular eviction procedure.

Resident must be notified about date and hour of committee eviction three days before the deadline with written notice.

Resident must pay costs of committee eviction, room cleaning, debts and possible material damage.
88. article
Two-person committee, that is constructed by Vila Zvezda danica Maribor house caretaker and the person presenting the house floor must wright down all personal belongings of the resident in three copies. The copies must be signed.
89. article
Committee eviction can be done also in absence of the resident if he was notified about the eviction deadline.

Resident may get his belongings in the house inventory after he pays all the costs responsibilities towards Vila Zvezda danica Maribor.
91. article
If resident does not return for his belongings in 6 months from the cleaning day of inventory is counted as if he/she does not want the belongings back. From that day on Vila Zvezda danica Maribor is not responsible for safekeeping the resident belongings and it may destroy it or sell it. With the money from selling the belongings Vila Zvezda danica Maribor pays the possible debts and costs.
XIII. RIGHTS AND DUTIES OF WORKES IN VILA ZVEZDA DANICA MARIBOR
1. Entering resident rooms

a) Once per month, without notifying the residents, house caretaker or worker checks out the devices and equipment in all places of the house.
b) Accredited worker has a right to enter all rooms, when doing maintenance work and removing the damage.
c) If in heating time or bad weather conditions residents room is opened, worker or house caretaker handles the problem by himself.

In all other cases may caretaker and maintenance worker enter the room in time of 8 am and 10 pm to do the following:
- inventory writing up of basic assets of Vila Zvezda danica Maribor that were not reported by the resident,
- sanitary-hygiene control of the room,
- committee eviction.

Owner, house caretaker or radar has a right to demand a legitimization of the person, for which is suspected that is not the resident of the house and is not on a visit at the resident. That person must be legitimized and leave the house immediately, otherwise responsible person calls the police.
2. Duties of workers in Vila Zvezda danica Maribor when entering the room

House caretaker or 2-person committee that have an errand in resident room are responsible to:
- knock three times and wait for the resident to open,
- introduce themselves,
- tell with what cause, errand or job they wish to enter the room.

1) If resident is not in the room, worker of committee may enter the room, without him/her knowing only if they are doing a work defined from house rules.
2) After done job, errand in the room, resident must be notified about it.

If resident does not open the room door and the doors are not possible to open with spare key it counts as if resident refuses to open the door and is not enabling to enter the room.

While doing the job in the room, worker may concentrate only to needed job, that he entered the room for and is not allowed for the worker to stay longer in room than needed.
XIV. RADAR WORK

Radar is chosen by Vila Zvezda danica Maribor and his job is to have control by defined time and to respect the house rules.
Instructions for radar job, radar responsibility and other activities connected to doing a radar job are defined by the owner.
In case of conflict between radar and resident, radar must be considered toward the resident. All irregularities radar writes down in radar book. This is a basic for possible disciplinary actions.

Radar is in Vila Zvezda danica Maribor at the possibility of house order violations, his job is not take care of safety of the residents and their personal belongings. In case of theft or other law violations is necessary to call the police.

1) Person (if he/she is resident of Vila Zvezda danica Maribor or not) and is violating house order and peace after 22. hour (10 pm) or is in the house, radar legitimize and finds out their identity and if there are the resident of the house. Radar gives out disciplinary measure against that person. In case that person is not the resident of the house, that person must leave the house immediately.
2) Radar must in case of violation of house order and peace after 10 pm in all places and area that belongs to Vila Zvezda danica Maribor act by the house rules.
3) Radar must considerate owners’ directions about radar job.

Radar has a right and duty to inform the owner with all the data about violators. If radar warning is not enough, he must call the police.
XV. PERSON ON DUTY WORK

Each resident of Vila Zvezda danica Maribor must do person on duty job, by the list that is written down by floor representative. The attention of this job is making order and peace as in-house rules and partly for undisturbed life in each house floor. This job is meant for house rules fulfilment by all residents.

Basic duties of person on duty job is: regular dish washing – right after the usage, cleaning the dishes after residents, emptying waste bin in common space, watching out for smokers in the house, cleaning the kitchen, legitimizing visitors, control of sanitary place, letting know the caretaker about possible damages… Tasks can be added, by the agreement of residents.

Job on duty must be done in the kitchen of each floor. This is part of responsibility of all residents and is not a payable job. When person on duty has a faculty work or other errands, he/she must find someone to replace him/her. If the person on duty is not on his station, there might be a money fine.

In plan Vila Zvezda danica Maribor management is video control of the entry to the house and apartments. Main goal is following house rules and not protection of residents. In accommodation contracts residents must be notified and sign that they agree with this kind of safety control.
XVII. FINAL REGULATIONS

Changes of house rules are done by the owner of Vila Zvezda danica Maribor or suggestions by students living in the house.

House rules Vila Zvezda danica Maribor is valid in eight days after being posted.
